PhD-project: Children's right to free movement in the European Economic Area
"Children's right to free movement within the EEA - the genuine enjoyment doctrines applicability within the EEA"
The project is about children's right to free movement within the European Economic Area (EEA), focusing on whether and to what extent the genuine enjoyment doctrine can be transposed into the EEA. The CJEU established a right to be accompanied by third country national primary carer without prior exercising of free movement rights, first in the case of Ruiz Zambrano. Within the EEA, Union citizenship does not exist, making it unclear whether and to what extent a minor EEA national can rely on EEA law to confer a derived right of residence for third country national parent, without exercising their free movement rights.
